Welcome to Beyond the Frame. These Terms and Conditions govern your use of our website and the booking of our photography services. By accessing our website or booking a session, you agree to comply with these terms. Please read them carefully.

Service Bookings and Agreements

• A booking is only considered confirmed once the required retainer fee is paid and any necessary contract or agreement is signed.
• We reserve the right to decline any booking request at our discretion.
• The specific details of your photography session (time, location, deliverables) will be outlined in your individual booking agreement or invoice.

Pricing and Payments

• Prices for our photography packages are subject to change without notice. However, once your booking is confirmed with a retainer, your quoted price is locked in.
• The remaining balance for any photography service must be paid in full prior to or on the day of the session, as specified in your agreement.
• We use trusted third-party payment processors to handle transactions securely.

Delivery of Images

• We will make every effort to deliver your edited digital images within the timeframe estimated during booking (typically 5-7 days for standard sessions).
• Images are delivered via a secure online gallery. You are responsible for downloading and backing up your images within the gallery's active window.
• We provide fully edited, high-resolution JPEG files. We do not release raw, unedited image files under any circumstances, as they do not represent our finished work.

Copyright and Usage Rights

• Photographer's Copyright: Beyond the Frame retains the primary copyright to all images created. We reserve the right to use the images for advertising, display, website updates, and portfolio use, unless a privacy agreement has been explicitly requested and signed.
• Client Usage: You are granted a personal use license for the downloaded images. This allows you to print the images for personal use and share them on personal social media accounts.
• Commercial Use: Images may not be used for commercial purposes, sold, or entered into contests without prior written consent and potential additional licensing fees.

Artistic License and Editing

• Images are edited in our signature style as seen in our portfolio. Editing covers color correction, exposure adjustment, and basic retouching.
• Extensive custom retouching (e.g., removing background objects, body modification) is not included in standard packages and may incur additional fees.
• We retain the artistic license to decide which images are delivered to the client. Images that do not meet our technical or artistic standards (e.g., blurred, eyes closed) will not be included in the final gallery.

Limitation of Liability

• In no event shall Beyond the Frame be liable for any direct, indirect, incidental, special, or consequential damages arising out of your use of our website or photography services.
• Our maximum liability for any claim relating to our photography services is strictly limited to a refund of the monies paid by you for those services.

Amendments

We reserve the right to modify or update these Terms and Conditions at any time without prior notice. Your continued use of our services constitutes acceptance of those changes.
